Sales and Delivery Terms
These sales and delivery terms apply to purchases or leases of goods and services on https://memorycube.dk/ and https://plus.memorycube.dk/ owned by Carity ApS, CVR no. 40831371, address Gustav Wieds Vej 19, Kl, 8000 Aarhus C, phone 27293927, and email address info@carity.dk. Agreements are entered into in Danish. The right of withdrawal only applies to transactions via the aforementioned websites.
Payment and Delivery of Purchased Goods
We accept payment with Visa and MasterCard. The amount is only charged when the item is shipped, delivered, or installed by Carity personnel. Prices are stated in Danish kroner including VAT on pages aimed at private consumers. On pages aimed at public institutions and private companies, the price is explicitly stated without VAT. A shipping fee may be added to the price. A payment fee may be applied, depending on the chosen payment method. We deliver the item within 3-5 business days after customization is completed. We deliver items with Postnord. We deliver to Denmark.
Lease and Delivery of Leased Goods
We accept payment with Visa and MasterCard as a monthly subscription payment. The amount for the first month is charged when the item is shipped or delivered. Subsequently, the monthly subscription payment is charged in advance, i.e., at the beginning of each new monthly period. The monthly payments cease after returning all leased system components to Carity in functional condition. You pay any expenses associated with returning and are responsible for packaging that ensures return in functional condition. The monthly leasing costs are stated in Danish kroner including VAT on pages aimed at private consumers. On pages aimed at public institutions and private companies, the price is explicitly stated without VAT. A shipping fee may be added to the price. A payment fee may be applied, depending on the chosen payment method. We deliver the item within 3-5 business days after customization is completed. We deliver items with Postnord. We deliver to Denmark.
Right of Withdrawal
You have the right to withdraw from an agreement without reason within 30 days. The withdrawal period expires 30 days after the day you or another person of your choice (but not the carrier) takes physical possession of the item. If the deadline expires on a public holiday, Saturday, Constitution Day, Christmas Eve, or New Year’s Eve, the deadline is extended to the following business day. You withdraw by notifying us that you are withdrawing. You can, for example, send a letter, an email, or a text message stating that you are withdrawing to Carity ApS, Tueager 1 8200 Aarhus N, phone 27293927, info@carity.dk. You cannot withdraw by refusing to receive the item or by failing to collect it without simultaneously notifying us that you are withdrawing. You can use the standard withdrawal form provided by law

But it is not mandatory to use this form. The withdrawal period is met if you send your notice of withdrawal before the withdrawal period has expired.
Return of the Item and Return Costs
If you have withdrawn from the purchase of an item or wish to terminate a lease agreement, you must send or deliver the item including any components (cables and power supply, etc.) to us or to Gustav Wieds Vej 19, Kl, 8000 Aarhus C without undue delay and no later than 14 days after you have notified us that you wish to withdraw from your purchase or terminate your lease agreement. The deadline is met if you return the items before the expiry of the 14 days. Items cannot be sent cash on delivery or without distribution. You bear the costs associated with returning the item.
Refund of Payment for Purchased Goods upon Withdrawal
When you withdraw, we refund all payments received from you, including any delivery costs. We refund the amount without undue delay and in any case no later than 14 days from the date we received your notice of withdrawal. However, we may withhold the refund until we have received the goods back, or until you have provided evidence that you have returned the goods. We will carry out such a refund using the same means of payment as you used for the original transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the refund.
Testing of the Item and Packaging
You are only liable for any reduction in the value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. If you have used it in a way that means we cannot sell or lease it at full price again, after normal cleaning and testing, you should expect that we deduct the depreciation from the amount you are to receive back. If the item no longer has a commercial value, we do not refund the purchase amount. You must return the item including cables and manual in the original packaging. You should also ensure that the item is properly packaged when you return it. You bear the risk for the package/goods until we receive it. Therefore, keep the postal receipt and any track and trace number.
Termination of Lease Agreement without Returning the Leased Item, or when Returning a Defective Item.
Normal termination of the lease agreement occurs by returning the leased item. If this is not possible because the item is lost or defective, return as many parts as possible. We will then charge for the missing parts and repair of any defective parts. The amount owed can be a maximum of 12 months’ rent in cases where the item is lost. If the unit is lost, we will close the data subscription for the lost unit, and it will no longer be usable.
Complaint – if there is Something Wrong with the Item
As a consumer, you have a 24-month right of complaint under the Sale of Goods Act. This means that if the item has a defect, and you complain in a timely manner, you have the right, in the first instance, to have the item repaired or replaced. If this cannot be done, or it is not done within a reasonable time, you may, depending on the circumstances, get your money back or a price reduction. A defect is, for example, a manufacturing or material defect, or incorrect information about the item. However, normal wear and tear, or damage you have caused to the item yourself, is not a defect. If you discover a defect, you must complain to us “within a reasonable time”. We recommend that you complain as soon as possible, especially in the case of transport damage. If you complain within 2 months after the defect is discovered, it is always within a reasonable time. If the complaint is justified, we will refund your reasonable and necessary shipping costs. If you believe the item has a defect, we ask you to describe the problem as detailed as possible. Remember that the item must always be sent in proper packaging and get a receipt for shipping. Keep the postal receipt including information on shipping costs and any track and trace number.
Information about Complaint Options
A complaint about a product or service purchased from us can be submitted to the Center for Dispute Resolution, Nævnenes Hus, Toldboden 2, 8800 Viborg. You can complain to the Center for Dispute Resolution via www.forbrug.dk. The EU Commission’s online complaint portal can also be used when submitting a complaint. This is particularly relevant for consumers residing in another EU country. The complaint is submitted here – http://ec.europa.eu/odr. Information We Collect
This page describes the categories of information collected by Carity when purchasing and using MemoryCube.
Automatic Collection of Information
- IP address
- Which browser you use
- Date and time of your visit, content you access, and how you use our website.
- Whether you make orders, information about purchases, and your payment history
If you are registered as a customer with Carity ApS, we connect the automatically collected data with other information we have about you (described below). This information is used for various purposes, as described below.
Information You Provide when Creating an Account or Making a Purchase:
- Name
- Contact information (email address, physical address, phone number)
- Password
- Payment information (such as payment card or bank details)
It is not possible for employees of Carity ApS or our subcontractors to access and read the password you have chosen. We therefore cannot help recover the password if it is lost. We can only reset it and replace it with a temporary password that you can change afterwards.
Information You Provide when Personalizing a Product
When personalizing a product on our website, you can add text or images that contain personal information, such as names or pictures of people. The physical images printed during personalization will be handled by selected production staff at Carity ApS.
Who Can See the Images Uploaded via the MemoryCube App?
Everything uploaded is private and cannot be seen by unauthorized persons. Images and videos are stored encrypted on our server for synchronization across your own devices (app instances and MemoryStation), as well as for backup. Carity ApS will only access content with explicit consent at your request for purposes such as extraction for photo books, data recovery, etc.
Can Invited Users to the Same MemoryCube See each Other’s Pictures?
Yes. When you invite other relatives to contribute to a specific MemoryCube, they automatically get access to the other pictures and comments that have been uploaded to the system. All users associated with the same MemoryCube system are equal and can view and edit each other’s pictures, including deleting pictures or changing comments.
Collection of Information when Using MemoryCube
We can see when MemoryCube is turned. We cannot see the pictures and videos that are displayed. We use log data to improve our understanding of the use of MemoryCube, and for system diagnostics in connection with customer service.
Purpose of Collecting this Information
We use the collected personal information to:
- Complete your order and offer targeted customer service
- Maintain, improve, and manage our website
- Inform you about products and services that may be relevant to you
- Improve and personalize the experience and use of our website and services
- Identify and prevent fraud
- Improve the security of our network and information systems
- Improve our understanding of how our visitors use our website, and analyze the effectiveness of our campaigns and advertisements.
Who Has Access to My Information?
We limit access to your information to employees who need to know them. Employees of Carity ApS are obligated to protect the information and keep it confidential.
We may disclose information you have provided to other companies that may process it on our behalf, including companies in our value chain whose functions are:
- To process or deliver your order
- To store and secure your information
- To process your payment
- Marketing, analytics, and fraud detection
- Customer service

All communication between devices is SSL-encrypted, all files stored on our server are encrypted, and there is strict access control, so only users with email addresses you invite will be able to access your information.
